    ICE Is Coming to Town: Know Your Rights As a Black Immigrant or Black American

    Navigating immigration enforcement in public and private life can feel challenging and uncertain.

    For Black immigrants, understanding your rights and knowing how to exercise them is essential. Being informed and prepared can make all the difference if you ever encounter Immigration and Customs Enforcement (ICE).

    How to Handle an ICE Encounter in Public: What You Need to Know

    These are some of the basic rights you should keep in mind if ICE agents are trying to stop you in public:

    Right to Remain Silent

    You don’t have to disclose your immigration status or where you were born.

    Tell ICE loudly that you are not speaking.

    Don’t show IDs that show your country of origin.

    Right to Talk to a Lawyer

    You have the right to immediately speak to a lawyer if arrested.

    Know where to find an immigration lawyer to help you.

    Right to Refuse a Search

    You are not obligated to consent to a search of yourself or your belongings.

    Do not submit false documents or lie to ICE agents.

    If arrested, do not sign documents unless you have understood them and talked to a lawyer.

    An unexpected visit from ICE can be intimidating. Protect yourself by knowing these rights:

    Do Not Open the Door

    The ICE can’t come into your house without a court-issued search warrant.

    A deportation order is not the same thing as a search order. Ask them to bring a warrant under the door or bring it to a window for a cross-check.

    Right to Remain Silent

    You don’t have to report your birthplace or status as an immigrant. 

    Talk behind closed doors if you want to speak to the officers.

    If arrested, ask for access to an attorney as soon as possible.

    Stay Informed, Stay Safe

    Remaining calm and exercising your rights can significantly impact the outcome of an ICE encounter. Defending yourself starts with preparation and knowledge. Understand your rights, have a plan and stay informed. Your safety and peace of mind depend on it.
